Muscle Up Store Terms and Conditions

Article 1 - Definitions

• Muscle Up Store: the webshop managed by Muscle Up Store vof, located at Wieken 91, 1622 GR in Hoorn and registered with the Chamber of Commerce under number 94081689.
• Customer: the natural person or legal entity who enters into an agreement with Muscle Up Store.
• Agreement: the distance purchase agreement between Muscle Up Store and the Customer.
• Products: all items offered through the Muscle Up Store webshop.
• Website: the Muscle Up Store website, which can be consulted via www.muscleupstore.nl

Article 2 - Applicability

• These general terms and conditions apply to all offers, orders and agreements of Muscle Up Store.   
• These general terms and conditions can only be deviated from in writing.
• If one or more provisions of these general terms and conditions are null and void or are annulled, the other provisions of these general terms and conditions will remain fully applicable.

Article 3 - Offer and Agreement

• Muscle Up Store's offer is without obligation and can be changed at any time.
• The agreement is concluded at the moment that the Customer definitively places the order via the website.
• Muscle Up Store will confirm receipt of the order by email.
• Obvious errors or mistakes in the Muscle Up Store offer do not bind Muscle Up Store.

Article 4 - Prices and Payment

• All prices on the website are in euros and include VAT, unless otherwise stated.
• Shipping costs are not included in the price and are stated separately.
• The Customer can pay via the payment methods indicated on the website.
• Muscle Up Store reserves the right to refuse orders or to impose additional conditions, for example in the event of a negative credit score.

Article 5 - Delivery

• Muscle Up Store aims to deliver orders within two working days.
• The delivery time is indicative and may differ, for example due to force majeure.
• Muscle Up Store is not liable for delays in delivery.
• Delivery will take place at the address specified by the customer.
• The risk of damage or loss of the products passes to the customer at the time of delivery.

Article 6 - Right of withdrawal

• The customer has the right to cancel the agreement within 14 days after receipt of the products without giving any reason.
• The customer can make use of revocation as described on the website.
• During the cooling-off period, the customer will handle the products and packaging with care.
• The customer must return the products to Muscle Up Store within 14 days of cancellation.
• The costs for returning the products are at the expense of the customer.
• Muscle Up Store will refund all payments made by the customer, including any delivery costs, when the entire order is returned within 14 days of receipt of the cancellation.

Article 7 - Exceptions to the right of withdrawal

• The right of withdrawal does not apply to Products:
• that spoil quickly or have a limited shelf life;
• which are sealed and are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery;
  which after delivery are, by their nature, irreversibly mixed with other products;
• that are clearly personal in nature;
• which were made at the express request of the customer.

Article 8 - Warranty

• Muscle Up Store guarantees that the products comply with the agreement and the reasonable requirements of soundness and usability.
• If a product does not meet the warranty, Muscle Up Store will repair or replace the product free of charge.
• The warranty does not apply if the customer has repaired or modified the product himself, or if the product has been used incorrectly.

Article 9 - Complaints

• Complaints about the products or delivery must be submitted in writing to Muscle Up Store within a reasonable time after discovery.
• Muscle Up Store will respond to the complaint within 14 days of receipt.
• If a complaint is justified, Muscle Up Store will provide a reasonable and appropriate solution.

Article 10 - Liability

• Muscle Up Store is not liable for damage caused by the use of the products, unless the damage is caused by intent or gross negligence on the part of Muscle Up Store.
• Muscle Up Store's liability is limited to the amount paid out in the relevant case under Muscle Up Store's liability insurance.

Article 11 - Privacy

• Muscle Up Store respects the privacy of the customer and processes personal data in accordance with the General Data Protection Regulation (GDPR).

Article 12 - Intellectual Property

• All intellectual property rights relating to the Website and the Products are vested in Muscle Up Store.
• It is not permitted to copy or distribute the Website or the Products without the permission of Muscle Up Store.

Article 13 - Applicable Law and Disputes

• These general terms and conditions and all agreements between Muscle Up Store and the customer are governed by Dutch law.
• Disputes will be submitted to the competent court in the Netherlands.

Article 14 - Amendment of General Terms and Conditions

• Muscle Up Store reserves the right to change these terms and conditions.
• Changes will be announced on the website.
